November 24, 2008 - An investor in shares of VMWare Inc (NYSE: VMW) filed a lawsuit in the U.S. District Court for the Central District of California over alleged violations of Federal Securities Laws by VMWare Inc in connection with certain allegedly false and misleading statements made between April 22, 2008 and July 22, 2008.
The complaint alleges that as a direct result of the market learning of defendant’s misrepresentations and omissions, the price of VMWare Inc shares declined and plaintiff suffered a loss on their investments in VMWare Inc. By misrepresenting VMWare Inc’s financial performance, defendants presented a misleading picture of its business and prospects. Thus, instead of truthfully disclosing April 22, 2008 through July 22, 2008 that VMWare Inc business was not as healthy as represented, defendants failed to disclose VMWare Inc actual financial position. The public revelations regarding the truth about VMWare Inc’s business and financial performance, when disclosed to the market, caused the value of the VMWare Inc’s common stock to decline, thereby damaging plaintiff, so the lawsuit.
