October 5, 2011 - The court approved the settlement, entered the orders approving the plan of allocation, the motion for attorneys’ fees and expenses, and dismissed the action with prejudice.
June 9, 2011 - The court preliminarily approved the settlement.
May 3, 2011 - Parties filed a stipulation of settlement.
July 22, 2009 - The defendants filed a motion to dismiss.
October 10, 2008 - The court ordered the case transferred to the U.S. District Court for the Northern District of Oklahoma.
August 26, 2008 - A plaintiff filed a notice of voluntary dismissal.
July 24, 2008 - An additional investor filed a complaint in the U.S. District Court for the Southern District of New York on behalf of investors who purchased SemGroup Energy Partners LP (NASDAQ: SGLP) common shares between February 13, 2008 through July 17, 2008.
July 22, 2008 - Another investor filed a complaint in the U.S. District Court for the Northern District of Oklahoma on behalf of investors who purchased SemGroup Energy Partners LP (NASDAQ: SGLP) common shares between February 20, 2008 through July 17, 2008.
July 21, 2008 - An investor in shares of SemGroup Energy Partners LP (NASDAQ: SGLP now known as BlueKnight Energy Partners LP NASDAQ: BKEP) filed a lawsuit in the U.S. District Court for the Southern District of New York against SemGroup Energy Partners LP over alleged violations of Federal Securities Laws between February 20, 2008 through July 17, 2008.
The complaint charges SemGroup Energy Partners LP and its officers and directors with failing to disclose the risky trading strategy that eventually contributed to its downfall. The lawsuit alleges that SemGroup Energy Partners LP misrepresented in the prospectus for the secondary offering the financial strength of its parent company and failed to disclose its financial difficulties or high risk for financial problems associated with risky crude oil hedging strategies that presented a material risk of default and bankruptcy. According to the complaint the true facts were first disclosed to investors on Thursday, July 17, 2008, when it was revealed that because of its hedging strategies the SemGroup L.P. was at risk of filing for bankruptcy. No class has yet been certified in this action. The plaintiff seeks to recover damages.
On July 22, 2008 SemGroup Energy Partners LP and 24 affiliates filed voluntary Chapter 11 petitions with plans to liquidate in order to pay back lenders, just one day after a non-debtor, limited partnership affiliate of the privately held energy company was sued with a putative securities class action over soured oil investments. On Tuesday 22nd, 2008 the debtors filed their petitions along with first-day motions and a request for joint administration in the U.S. Bankruptcy Court for the District of Delaware.
On December 1, 2009 SemGroup Energy Partners LP's name changed to BlueKnight Energy Partners LP.
