Lawsuit Overview
January 9, 2018 - An investor in the Monkey Capital ICO filed a lawsuit in the U.S. District Court for the Southern District of Florida over alleged violations of Federal Securities Laws in connection with the scheduled-but-cancelled 2017 Monkey Capital ICO (initial coin offering).
According to the complaint the plaintiff alleges that Monkey Capital LLC, Monkey Capital Inc., and the companies' founder and principal fraudulently promoted an ICO and engaged in an unregistered offering and sale of securities that violated numerous state and federal securities laws, including Sections 5, 12(a), 15, and 17(a) of the Securities Act of 1933, 15 U.S.C. §§ 77e, 77l(a), 77o, and 77q(a).
Furthermore, the plaintiff claims that the defendants postponed the original ICO commencement date mid July 2017 to early August and stated that the ICO period would remain open until early September. However, so the plaintiff, past early August 2017 no ICO was commenced and instead, at or about that time, Monkey Capital’s fundraising website disappeared.
