Investigation Overview
According to a press release a law firm is currently investigating possible securities violations in relation to public statements made by the AtriCure, Inc (NASDAQ: ATRC) between May 10, 2007 and October 31, 2008.
According to the press release the investigation focuses on the AtriCure, Incs October 31, 2008, press release in which AtriCure disclosed that it had received a letter on October 27,2008 from the U.S. Department of Justice-Civil Division informing the Company that the Department of Justice- is conducting an investigation of potential False Claims Act and common-law violations relating to the AtriCure, Incs surgical ablation devices. According to the press release by AtriCure, Inc the Department of Justice is investigating the Department of Justice s marketing practices utilized in connection with AtriCures surgical ablation system to treat atrial fibrillation, a specific use outside the Federal Food and Drug Administrations 510(k) clearance. AtriCure, Inc. further disclosed that the Department of Justice is investigating whether AtriCure instructed hospitals to bill Medicare for surgical ablation using incorrect billing codes. The Wall Street Journal reports today, November 4, 2008 that ArtiCure, Incs shares have been declined nearly 40% after the company disclosed the investigation by the Department of Justice.
