October 15, 2015 - An investor in shares of BofI Holding Inc (NASDAQ: BOFI) filed a lawsuit in the U.S. District Court for the Southern District of California over alleged violations of Federal Securities Laws by BofI Holding Inc in connection with certain allegedly false and misleading statements made between September 4, 2013 and October 13, 2015.
According to the complaint the plaintiff alleges on behalf of purchasers of BofI Holding Inc (NASDAQ: BOFI) common shares between September 4, 2013 and October 13, 2015, that the defendants violated Federal Securities Laws. More specifically, the plaintiff claims that between September 4, 2013 and October 13, 2015 defendants allegedly made false and/or misleading statements and/or failed to disclose that BofI Holding Inc’s internal controls were frequently disregarded, that BofI Holding Inc’s Federal Bank’s Bank of Internet USA’s borrowers included foreign nationals who should have been off-limits under federal anti-money-laundering laws, that many BofI Holding Inc’s Federal Bank’s Bank of Internet USA accounts lacked required tax identification numbers, that BofI Holding’s Federal Bank’s Bank of Internet USA fired an internal auditor who raised the foregoing issues to management and to federal regulators, and that as a result of the above, the Company’s statements regarding its internal controls and other financial statements were materially false and misleading at all relevant times.
BofI Holding Inc reported that its Net Income increased from $29.48 million for the 12 months period that ended on June 30, 2012 to $82.68 million for the 12 months period that ended on June 30, 2015.
Shares of BofI Holding Inc (NASDAQ: BOFI) increased from $65.67 per share in October 2014 to as high as $140.68 per share on October 12, 2015.
On October 14, 2015, it was reported that a federal lawsuit has been initiated against BofI Holding Inc by its former auditor. According to the report, the former auditor claims he was fired after reporting alleged wrongdoing by BofI Holding Inc to federal regulators.
On October 14, 2015, BofI Holding Inc (NASDAQ: BOFI) declined to as low as $99.12 per share.
